• Hon Michael Kirby AC CMG provides a thirty-year retrospective on the OECD Privacy Guidelines in "The History, Achievement and Future of the 1980 OECD Guidelines on Privacy", describing the main achievements by which the OECD Guidelines built on predecessors and how the Guidelines might be built upon for the future.
  
  
• In "Developing a method for site-specific wastewater analysis ...". The multidisciplinary team of Prichard et al explain how prison wastewater can be analysed to determine not only the prevalence of specific drugs, but also the effectiveness of prison anti-drug strategies.
  
  
• In his paper "Group Consent & The Nature Of Group Belonging: Genomics, Race & Indigenous Rights" Jason G Allen argues that the group consent principle in international and domestic bioethics guidelines endangers other aspects of the Indigenous rights project. He argues for a reformulation of the principle to better meet the underlying principles and objectives of bioethics.
  
  
• Kift, Campbell, Butler discuss the darker side of the web 2.0 in particular how the online environment can be used as a forum for harrassment and intimidation of youth and the adults and institutions responsible for their care. In their paper, "Cyberbullying In Social Networking Sites & Blogs: Legal Issues for Young People & Schools", the authors outline the extent of the problem from a legal standpoint and make recommendations about how to deal with the problem.
  
  
• Val Barrett, Manager of the ACT Hansard discusses risks associated with the use of the parliamentary record in light of changing technologies in her paper "Releasing the Record of Parliamentary Proceedings: Identifying and Controlling the Risks".
  

 

Laws Unmanned : A special edition on the legal, ethical and social implications of unmanned technology

• In Gogarty & Hagger's work, "The Laws of Man Over Vehicles Unmanned", the authors provide a lengthy overview of the legal, social and ethical issues raised by the increasing use of automous and semi-autonomous robotic vehicles, or 'drones'. The authors trace the historical impetus towards the development of this technology and examine its current use in both military and civilian contexts. While the authors note many of the concerns and difficulties involved in the regulation of this technology, they do not come to any definite conclusions regarding appropriate legal responses to these issues. Rather, the authors invite futher debate and discussion on the questions raised by this technology in this journal.

• Hon Michael Kirby AC CMG discusses the use of forensic evidence, especially DNA evidence by the courts in "Forensic Evidence: Instrument of Truth or Potential for Miscarriage?"
  
  
• The Panel Case litigation is the subject to critical review by Ben Mee. In his article, Laughing Matters: Parody and Satire in Australian Copyright Law Mee considers the impact of that case on media producers, in particular on their assumption that the use of copyright material for entertainment purposes would be protected from litigation due to industry goodwill, de minimis use or the provisions of the copyright legislation.
  
  
• In Nanotechnology and the International Law of Weaponry: Towards International Regulation of Nano-Weapons, Dr Hitoshi Nasu and Associate Professor Thomas Faunce examine growth of nano-weapons and the ‘regulatory failure’ of international humanitarian law and arms control law to sufficiently deal with their dangers.
  
  
• The Biobanks Information Paper (National Health and Medical Research Council of Australia) by Professor Margaret Otlowski, Professor Dianne Nicol and Dr Mark Stranger was produced by the National Health and Medical Research Council to inform the establishment, management and governance of biobanks in Australia and is reproduced as a peer reviewed work for an academic audience in this journal. The authors describe the importance of biobanks for national public health and medical research whilst highlighting the social, ethical and legal implications of the use of the genetic information stored within them. The aim of the paper is to “promote best practice in biobanks, and to stimulate thought and discussion about best practice, by identifying the issues to be considered”.

This was the first edition to be overseen by Dr Brendan Gogarty, who took over the role of Editor in Chief from Michael Stokes. Brendan works with Bruce Newey, the new General Editor of the Journal. Professor Dianne Nicol will continue in her role as Associate Editor. The Editorial Board sincerely thanks Michael for all his hard work and stewardship of the journal over the last five years.

• "Virtual Justice in the Bush", by Anne Wallace, deals with the use of information technology, such as ideoconferencing and broadband, to assist courts delier justice to remote regions.
  
  
• In "The University Academic as a Fiduciary", Lynden Griggs and Rohan Price consider the implications of the recent Federal Court of Australia case, University of Western Australia v Gray, a case about the ownership of an invention made by an academic staff member in the employ of an academic institution.
  
  
• In "The Contractual Legalities of Buying and Selling on EBay", Drs Kariyawasam and Guy consider the scope and content of a contract and consumer protection law governing the buying and selling of goods on eBay.
  
  
• "The Laws of Man Over Vehicles Unmanned", by Brendan Gogarty and Meredith Hagger, examines the myriad of legal, social and ethical issues raised by the increasing use of autonomous and semi-autonomous 'drones' in a variety of milieus.

 

General Edition vol 21 issue 3

The Editorial Board welcomes scholarly and research articles on any area of information, science and technology law for inclusion in the general edition of the Journal of Law, Information and Science.
